Letter of Claim for debt: what it means before court

What a Letter of Claim means before a debt claim in England and Wales, the response period and why it is not yet a CCJ.

A Letter of Claim under the Pre-Action Protocol for Debt Claims is a formal pre-court step used where a business is claiming payment of a debt from an individual in England and Wales. It is not a County Court judgment. The protocol gives the debtor time to respond and is designed to exchange information and consider resolution before proceedings are issued.

Do not ignore the response deadline

The Debt Claims Protocol provides a structured response process and supporting forms. If you need documents or dispute all or part of the debt, use the response process rather than assuming silence will stop the claim.

Pre-action is not the same as a court claim

A Letter of Claim comes before proceedings. If a County Court claim is later issued, court forms and formal court deadlines apply separately.

Use the time to check the debt

Check the creditor, account, balance, any assignment, limitation issues and whether payments or disputes have already been recorded. Seek advice quickly if the amount is substantial or the legal position is unclear.
