Overdales Letter of Claim
What an Overdales Letter of Claim means, the 30-day response period and how it relates to a possible County Court Claim.
Overdales says a Letter of Claim is sent before a County Court Claim and includes a Pre-Action Protocol Response Pack. Its current guidance says the recipient has 30 days from the date of the letter to respond before a County Court Claim may be issued. A Letter of Claim is therefore a legal pre-action stage, not the same thing as a CCJ.
What the letter means
Overdales says it sends a Letter of Claim after being instructed by its client and before issuing a County Court Claim where the matter has not been resolved.
The 30-day response period
Its FAQ states that the Response Pack explains how to respond within 30 days of the date of the letter. Ignoring the letter can increase the risk that a County Court Claim is issued.
Do not confuse a Letter of Claim with a CCJ
A Letter of Claim is a pre-action document. A County Court Judgment can only arise later if court proceedings are issued and the court enters judgment.
